This policy protects the Employer should an employee compensated under WIBA seek further recourse from the judicial system for a work related injury or illness. In this case, the employee has to prove negligence on the part of the employer. Under this policy there is no limit to what may be awarded in a court of law but compensation is usually far more than the WIBA entitlements. The claimant is paid the difference between the WIBA pay out and the court award.

This is an area which is full of fraudulent claims and therefore very good records of all employees’ injuries must be kept. Any employee can sue for death or bodily injuries suffered in the course of employment. Therefore, all employees should be covered under this policy from the cleaner to the managing director.
